Dave Min’s Statement On Gun Show Bill Injunction
IRVINE, CA — State Senator Dave Min has been a champion for gun violence prevention since he first sought public office. It was his 2021 bill that ended gun shows at the Orange County fairgrounds and his subsequent 2022 bill which expanded the scope of the ban to all public property in the state. Today, a federal judge issued a preliminary injunction against those two bills. Dave Min’s full statement on today’s events is below:
"Today's shocking injunction, a glaring example of judicial activism by a Trump-appointed judge, is a dire wake-up call to the very real dangers of GOP political control. It underscores the pressing imperative of electing a Democratic House majority to protect our values.
California's vital ban on gun shows at state properties, encompassing even our iconic fairgrounds sites, serves as a critical line of defense against the unchecked proliferation of firearms, including 'ghost guns' that circumvent essential background checks and traceability. This reckless decision– which essentially assumes its conclusion that any regulatory action related to guns is unconstitutional and further assumes– without any analysis or justification– that any such action creates the ‘irreparable harm’ required to issue a preliminary injunction– forces the state of California to host activities that we have determined we do not want on state-owned property.
While I am confident that this decision will be overturned on appeal, we cannot ignore the potentially catastrophic consequences it poses in the interim. Since being sworn into the State Senate in December 2020, I have sadly watched as gun violence has plagued the communities I represent, which are some of the safest in the country. The drive-by shooting of a 6-year old boy on the 55, the Orange office park shooting, the Taiwanese church shooting in Laguna Woods, the Cook’s Corner bar shooting, and so many others. I will continue fighting for gun violence prevention, but this decision underscores the barriers we are facing in that fight. Out-of-control judges who are essentially legislating from the bench must be reined in, and balance must be restored to our federal judiciary. Thoughts and prayers are no longer an adequate response to the mass shootings like the one we just saw in Maine. Action is required, and I pledge to push for action when I am elected to Congress next year.”
